It is expressly agreed by the parties and acknowledged by the independent contractor that:
1. The independent contractor will be paid a flat rate for performing labor services in accordance with this contract.
2. Pelican Labor Services, LLC has no right of control or direction over the manner, means, and methods that the independent contractor will use in carrying out the terms of this contract.
3. The independent contractor is responsible for providing all labor, material, supplies, equipment, and tools required to perform the work hereunder at the independent contractor’s own expense; and Pelican Labor Services, LLC shall not be liable to independent contractor for such expenses.
4. The independent contractor has no authority to enter into contracts or agreements on behalf of Pelican Labor Services, LLC. This agreement does not create a partnership between the parties.
5. The independent contractor expressly declares and states that it has complied with all federal, state, and local laws regarding business permits and licenses that may be required to perform the work described herein.
6. The independent contractor is responsible for purchasing and providing all insurance as may be required to perform the work described herein.
7. The independent contractor shall be paid by Pelican Labor Services, LLC and the independent contractor shall receive an Internal Revenue Service Form 1099 for all payments received from Pelican Labor Services, LLC.
8. Payroll taxes including federal, state, and local taxes shall not be withheld or paid by Pelican Labor Services, LLC on behalf of the independent contractor or for the employees of the independent contractor. The independent contractor shall not be treated as an employee with respect to the services performed hereunder for federal or state tax purposes. The independent contractor shall be responsible to pay all taxes as mandated by law.
9. If Pelican Labor Services, LLC is contacted by any State and/or Federal Agency for garnishments, a fee of $3.00 per pay period will be added to each paycheck for administrative fees.
I agree to reimburse Pelican Labor Services, LLC, for any and all expenses incurred during my 90 day probationary period of my work as a subcontractor including, but not limited to, background checks, drug screens, and training classes if I do not work for more than 90 days from the first scheduled work date. I give Pelican Labor Services, LLC permission to take any money owed out of my last check (s). If my last check does not cover the amount owed, I agree that I am liable for the remaining payment. Background checks will be reimbursed to Pelican Labor Services, LLC on first check.
I certify that information contained in this application is true and complete. I understood that false information may be grounds for not hiring me or immediate termination of employment at any point in the future if I am hired. I authorize the verification of any or all information listed above.
